1. When and what personal data may we collect about you?

We receive and process a certain amount of information, which may include personal data about you, in various ways:

  • When you provide us directly with your identification data (surname, first name, email, telephone number, organization, job title) via our Ouilive.co website in order to be called back for the purposes of organizing and creating your own challenge.
  • When you provide us directly with your identification data (surname, first name, email, telephone number, organization) via our Ouilive.co website in order to obtain more information about a current challenge.
  • When you enter your email address on Ouilive.co to subscribe to our newsletter
  • When you provide us directly with your identification data (surname, first name, email address, telephone number, organization, job title) when you take part in any promotional operation we organize online.
  • When we or our canvassing partners obtain your personal data (surname, first name, organization, function, e-mail) from legitimate sources for the purpose of informing you of our commercial offers by telephone and/or e-mail.

We track your activity and the way you use our website via our "cookie" tracking tools and technologies. This includes technical data automatically collected by our cookies, such as your browser type or terminal, your location or the source from which you access our site. 2. For what purposes and on what legal grounds do we collect your personal data?

We collect, process and store your personal data for the following purposes and on the following legal bases:

- When you contact us via our website, by filling in the forms to request a creation and/or take part in a challenge, we will process your personal data in order to contact you again, by telephone and/or email, to inform you of our services and commercial offers. The processing of your personal data is therefore based on your prior consent for us to contact you for commercial prospecting purposes.  

- When you enter your email address to receive our newsletter, we will process your personal data in order to send you our newsletter and to inform you of our services and commercial offers. The processing of your personal data is therefore based on your prior consent to us sending you our newsletter and on our legitimate interest in informing subscribers to our newsletter of our services and commercial offers.

- When you participate in a promotional operation, we will process your personal data in order to process your participation but also in order to inform you of our services and commercial offers. The processing of your personal data is thus necessary for the execution of your participation in the promotional operation concerned and based on our legitimate interest in informing participants in our online promotional operations of our services and commercial offers.

- When we or our prospecting partners obtain your personal data from legitimate sources, we will process your personal data in order to inform you of our services and commercial offers by e-mail. The processing of your personal data here is based either on your prior consent to be contacted in order to receive information on our services and commercial offers, or on our legitimate interest in sending our services and commercial offers to professionals who have been informed that their data would be used for this purpose at the time of initial collection, and this, with the right to object.  

- If you have accepted Ouilive.co's use of "cookies" tracking tools and technologies for statistical or marketing purposes, we will analyze your behavior and navigation on our website in order to measure and improve the performance of our site and our online advertising campaigns. This processing is based on our legitimate interest in measuring audience statistics and improving the performance of our targeted online advertising campaigns, following your acceptance of Ouigroup's use of the types of cookies concerned. 3. Who will have access to your personal data?

Your personal data will only be accessible by authorized persons within OuiGroup and for the purposes strictly necessary to their respective missions. This may include members of the following teams: sales department, marketing department.

Your personal data may also be shared with or processed by third parties in the following situations:

- Your personal data will be stored within the infrastructure of our host OVH located in Europe, allowing us to provide access to our site Ouilive.co in compliance with the contractual conditions signed with this host and can not derogate from the conditions of this privacy policy.

- Your personal data may be made accessible to our technical service providers, including in particular our CRM service provider or our e-mail and SMS routing service providers. Some of these service providers are located in the United States, a third country not recognized by the European Commission as having an adequate level of protection for personal data. However, we have taken care to ensure that these service providers respect the confidentiality of your personal data, and have signed the European Commission's standard contractual clauses with them to govern this transfer of data to the United States.

- The publishers of third-party cookies enabling us to collect your connection and browsing data on Ouilive.co for statistical or marketing purposes will have access to the data processed via their tools. Some of these service providers are located in the United States, a third country not recognized by the European Commission as having an adequate level of protection for personal data. However, we have taken care to ensure that these service providers respect the confidentiality of your personal data, and have signed the European Commission's standard contractual clauses with them to govern the transfer of data to the United States. In most cases, these third-party cookie publishers will only process your data in order to provide us with the service offered via these tools. Some of these third-party cookie publishers, namely Google, Facebook and Linkedin, nevertheless reserve the right to re-use your data on their own behalf, in particular in order to monitor your online browsing on the various applications and/or websites using their technology. You will find below more information on the data protection and privacy practices of the publishers concerned:

- Your personal data may also be communicated to the police (upon judicial requisition) or to any person legally entitled to receive such information (upon court order).

4. How will your data be hosted and stored?

We ensure that users' personal data is adequately and appropriately protected, and have taken all necessary precautions to ensure that data is kept secure and confidential, and in particular to prevent it from being distorted, damaged or communicated to unauthorized persons. In the event of any security breach, you will be notified in strict compliance with applicable regulations.

If you have a contractual relationship with OuiGroup, your data may be archived for a maximum of five years from the expiry of the relevant contract.

If you are only a prospective customer of OuiGroup and have no contractual relationship with us, your data may be stored for a maximum of three years from the date of your last contact with us (e.g., a request and/or message from you, or a click on a hyperlink in one of our e-mails). However, you will continue to receive our newsletter as long as you have not unsubscribed using the unsubscribe function in each communication.

5. Exercising your rights

In accordance with European regulations on the protection of personal data, you have the following rights:

- A right of access enabling you at any time to find out whether or not your personal data is being processed by our services and, if so, to have access to said personal data and to the information required by law concerning the way in which said data is processed,

- A right of rectification allowing you to request that any inaccuracies concerning your personal data be corrected as soon as possible,

- A right to erasure, enabling you to request as soon as possible that your personal data be erased when (i) its retention is no longer necessary for the purposes for which it was collected (ii) you have objected to the processing and therefore wish it to be erased (iii) the data has been processed unlawfully; (iv) the data must be erased to comply with a legal obligation under either European Union or French law,

- A right to the limitation of the processing of your personal data (i) when you contest the accuracy of the personal data collected for the period of time necessary to verify their accuracy, (ii) when, following processing established as non-compliant, you prefer the limitation of the processing to the complete erasure of the data (iii) when the personal data are no longer necessary for the purposes of the processing but are still necessary for the establishment, exercise or defense of legal claims; (iv) if you have objected to the processing of your personal data and would like the processing of your personal data to be restricted for such time as is necessary to verify whether the legitimate reason is justified,

- A right to portability enabling you to receive your personal data in a structured, commonly used and machine-readable format, or to request that this personal data be transmitted to another data controller, provided that this portability request relates to personal data that you have directly provided and that concerns you, and that this portability request does not infringe the rights and freedoms of third parties,

- A right to object to the processing of your personal data, in particular for the purposes of commercial canvassing, for reasons relating to your particular situation, in which case the processing in question will be terminated unless there are compelling legitimate grounds for continuing it in accordance with the applicable regulations,

- The right to define directives concerning the conservation, deletion and communication of your personal data after your death,

- If the processing of your personal data is based on your consent, you also have the right to withdraw this consent at any time.

OuiLive Application

Please read this privacy policy carefully to understand how your personal data is collected, processed and stored when you use the OuiLive Application (hereinafter "the Application").
For the purposes of this privacy policy, the party responsible for processing the collection of personal data is OuiGroup, a société par actions simplifiée (simplified joint stock company) with capital of 13,500 euros, registered with the Paris Trade and Companies Registry under number 899 219 234, whose registered office is located at 23 rue de Prony 75017 Paris (hereinafter referred to as "OuiGroup", "we", "us" and "our").

However, when you use our Application by connecting to a dedicated space on the Application via an access provided by the organization to which you belong (organization, educational establishment, club/association...), certain personal data concerning you will be processed by OuiGroup, acting in its capacity as data controller.

1. When can we collect personal data about you?

We receive and process a certain amount of information, which may include personal data, about you when you access and use the Application, in particular when you complete any information form on the Application or when you register or update your user account information.

2. What personal data do we collect?

A) User details

When you register on the Application, you will be asked to enter a certain amount of personal data (first name, last name, gender, email address, profile photo) required to create your user account and to identify yourself when you connect to the Application.

B) Connection data

When you connect to the Application, we collect your connection data, i.e. information that is automatically recorded by our servers when you access or use the Application. We also collect data related to the device you use to connect: operating system and version, phone model, manufacturer.

C) PHYSICAL ACTIVITY AND CHALLENGE PERFORMANCE DATA

When you use the Application, you may share with other users certain data about yourself, such as data on your sporting performance and movements, particularly in the context of sporting challenges in which you decide to take part via the Application. This data is collected via the Android "OuiLive Pedometer". The Application's own pedometer is directly linked to the sensors in your phone. Using these sensors, our pedometer is able to calculate the number of steps you take each day.
Some challenges also involve taking or sending photos and/or videos to the OuiGroup database in order to achieve certain objectives linked to these challenges. These photos/videos can only be viewed by OuiGroup teams for verification and moderation purposes, and by other challenge participants if the user has agreed to such sharing.

D) PHYSICAL ACTIVITY DATA COLLECTED VIA THIRD-PARTY SERVICES

Some phones do not have the sensor required for the application to function properly. In order to be compatible with all mobile devices, OuiGroup offers an API (application programming interface) with certain third-party applications, such as to retrieve your physical activity data.

OuiGroup will only be able to retrieve physical activity data collected by these third-party applications after first obtaining your explicit consent to such collection. When using these third-party applications, we will only access data that is strictly necessary for the operation of our Application, i.e. data relating to your sports performance and movement.

On the other hand, we will not access data not required for the operation of our Application that may be collected by these third-party applications, such as your geolocation.

This collection of your data via third-party applications can take place in different ways, depending on the service concerned:

  • Health (Apple): The App asks permission to connect to your 'Health' app present on your phone by default. The permissions requested are: 'Distance (walking and running)', 'Number of steps'. Once these permissions have been granted, OuiLive retrieves your total steps and distance covered directly from 'Health'. OuiLive has no access to the other data listed in your Health application.
  • Fit: You can connect your App user account to Google's Fit application. You must set up the Fit application with your Google account and grant the necessary authorizations. Once Fit has been initialized, choose the same Google account in the Application. OuiGroup will then have access to the number of steps and distances collected by the Fit application.
  • Fitbit: you can connect your Fitbit account to our application so that we can retrieve your user ID, which we'll use to access step and distance data from your Fitbit devices.
  • Garmin Connect: you can connect your Garmin Connect account to our application so that we can retrieve login information which we can use to access step and distance data from your Garmin devices.
  • Huawei Santé: The Application requests permission to connect to the "Huawei Santé" application, present by default on Huawei phones. The permissions requested are: 'Distance traveled' , 'Number of steps'. Once these permissions have been granted, OuiLive retrieves your total steps and distance covered directly from 'Huawei Santé'. OuiLive has no access to the other data listed in your 'Huawei Santé' application.

OuiGroup did not collect this information in the first place. However, we invite you to read the privacy policy and general terms of use of these third-party services.

3. For what purposes and on what legal grounds do we collect your personal data?

We collect, process and store your personal data for the following purposes and on the following legal bases:

- When you use the Application and create a user account, your contact details and login data will be processed and stored to enable the creation of your user account and your connection to the Application, in accordance with the commitments of our general terms of use. The processing of your personal data is thus necessary for the performance of the contract of use entered into with OuiGroup when you decide to use our Application.

- As part of the proper administration of the Application, we may also use your contact details to send you emails concerning your registration on the Application, information mails, technical notifications, updates, security alerts. The processing of your personal data is therefore also necessary for the performance of the contract of use entered into with OuiGroup when you decide to use our Application, and is also based on our legitimate interest in administering our Application.

- We also process your image (photographs and videos taken during challenges) as well as data relating to your physical activity and your performance in the challenges in which you take part. This data is processed to enable you to take part in the challenges organized via the Application. The processing of this data is based on your specific consent to the collection of such data by OuiGroup. Where such data is also collected by the organization responsible for the challenge concerned, we will only process such data on the instructions of and as a subcontractor to that organization. We therefore invite you to refer to the privacy policies applicable within that organization in order to understand more precisely the purposes and legal bases for which your organization processes personal data concerning you and collects it via our Application.

4. Who will have access to your personal data?

Your personal data will only be accessible by authorized persons within OuiGroup and for the purposes strictly necessary to their respective missions. This may include members of the following teams: customer service, support and technical assistance.

We may also share your personal data in the following situations:

- Your personal data will be stored within the infrastructures of our host located in Europe, allowing us to provide access to the Application in compliance with the contractual conditions signed with this host and not derogating from the conditions of this privacy policy.

- Your personal data may be made accessible to our technical service providers, including in particular our provider of error report analysis on the Application, as well as our email and push notification routing service providers. Some of these service providers are located in the United States, a third country not recognized by the European Commission as having an adequate level of protection for personal data. However, we have taken care to ensure that these service providers respect the confidentiality of your personal data, and have signed the European Commission's standard contractual clauses with them to govern this transfer of data to the United States.

- Your personal data may also be communicated to the police (upon judicial requisition) or to any person legally entitled to receive such information (upon court order).

Where applicable, you are also reminded that the organization to which you belong and which has allowed you to use the Application in order to participate in a challenge will also have access to your personal data. This same organization may also collect personal data about you via the Application, for its own purposes.

We therefore also invite you to refer to the privacy policies applicable within your organization in order to understand how your organization handles personal data concerning you and how it collects them via the Application proposed by OuiGroup.

In accordance with European regulations on the protection of personal data, OuiGroup has entered into a subcontracting agreement with your organization for the hosting and processing of your personal data on behalf of this organization.

5. How will your data be hosted and stored?

We ensure that users' personal data is adequately and appropriately protected, and have taken all necessary precautions to ensure that data is kept secure and confidential, and in particular to prevent it from being distorted, damaged or communicated to unauthorized persons. In the event of any security breach, you will be notified in strict compliance with applicable regulations.

All personal data will be destroyed immediately upon deletion of your user account on the Application or upon withdrawal of your consent in the case of data collected on the basis of your consent.
Sports performances and rankings linked to sports challenges on the Application are also deleted within one month of the end of the said challenge.

6. Exercising your rights

In accordance with European regulations on the protection of personal data, you have the following rights:

- A right of access enabling you at any time to find out whether or not your personal data is being processed by our services and, if so, to have access to said personal data and to the information required by law concerning the way in which said data is processed,
