These General Terms and Conditions of Use (hereinafter referred to as the "GTCU") are offered by OuiGroup, a société par actions simplifiée (simplified joint stock company) with capital of 1000 euros, registered with the Paris Trade and Companies Registry under number 814407208, whose registered office is located at 23 rue de Prony 75017 Paris (hereinafter referred to as "OuiGroup"). OuiGroup is the owner and publisher of the OuiLive application (hereinafter the "Application").

1. APPLICATION OF THE CGU

The purpose of these Terms and Conditions is to define all the conditions under which OuiGroup allows users to use this Application (hereinafter referred to as "Users"). All Users declare that they have read and accepted these GCU before using the Application. In the event that the User does not agree with one or more of the provisions of these GCU, he/she is requested not to use the Application.

2. ACCESS TO THE APPLICATION

Before using the Application, the User must ensure that he/she has the technical and computer resources to use the Application, in particular by ensuring that the computer configuration of his/her mobile terminal is in good condition and does not contain any viruses.
OuiGroup takes all appropriate measures to ensure that the User has optimal access to the Application, 24 hours a day, 7 days a week. However, OuiGroup cannot be held liable in the event of unavailability of the Application due to Internet failure, bugs or operating errors making access to the Application impossible. Access to the Application may also be temporarily interrupted for maintenance purposes.

3. USER ACCOUNT

In order to use the Application, the User must first create a user account on the Application. It is the User's responsibility to maintain the confidentiality and security of his/her login details for the Application. The User must immediately inform OuiGroup of any unauthorized use of his/her login details. OuiGroup cannot be held responsible for any loss or damage resulting from a fault or gross negligence on the part of the User to protect his/her login details.

4. OBLIGATIONS OF USERS

The User undertakes to comply with all the provisions of these GCU.
The User agrees to use the Application solely for personal use, in accordance with
these GCU. In this respect, the User refrains from:

Use the Application in any illegal manner, for any illegal purpose, or in any manner inconsistent with these TOS, Alter or artificially modify the usage and performance data on the Application in order to distort or artificially improve the User's performance and results and consequently the results/rankings of the challenges, Open more than one User account or open an account impersonating a third party.

To sell, copy, reproduce, rent, lend, distribute, transfer or license all or part of the contents appearing on the Application or to decompile, extract, disassemble, modify, display in a form readable by the User, attempt to discover any source code or use any software activating or comprising all or part of the Application. Attempt to gain unauthorized access to the Application's computer system or to engage in any activity that disrupts, diminishes the quality of or interferes with the performance or deteriorates the functionality of the Application.

To use the Application for abusive purposes by deliberately introducing viruses or any other malicious program and to attempt to gain unauthorized access to the Application.

Infringe OuiGroup's intellectual property rights.

5. PERSONAL DATA

The User is informed that OuiGroup processes personal data belonging to him/her via the Application. The processing of personal data by OuiGroup is described in greater detail in its privacy policy. In accordance with applicable regulations on the protection of personal data, the User has the right to oppose, access, limit, rectify, port and delete personal data concerning him/her, as well as the right to oppose for legitimate reasons and to withdraw his/her consent, by contacting OuiGroup at the following address: confidentialite@ouilive.co.

6. INTELLECTUAL PROPERTY

The Application and all its elements and content are protected by copyright, trademark, design rights and/or other intellectual property rights. All such rights are reserved worldwide.
No title or right whatsoever in any element or software shall be obtained by downloading or copying elements of the Application. The User is expressly prohibited from reproducing (other than for personal, non-commercial use), publishing, editing, transmitting, distributing, displaying, removing, deleting this Application and the elements and software it contains, nor from modifying it or performing any work using these protected elements as a basis. The name and trademark of OuiGroup or OuiLive, the associated creative challenges and concepts, logos, designs, stylized letters, figurative marks, and all signs represented on this Application are and shall remain the exclusive property of OuiGroup. Any use by the User of the aforementioned elements, company names, trademarks and distinctive signs belonging to OuiGroup is strictly prohibited without the express prior consent of OuiGroup.

8. MEDIATION / DISPUTES

In the event of a dispute arising from the interpretation and/or performance of the present Terms and Conditions or in relation to the present Terms and Conditions, the User may decide to submit the dispute with OuiGroup to a conventional mediation procedure or any other alternative dispute resolution method.
The User may visit the European platform for the settlement of consumer disputes set up by the European Commission at the following address, which lists all the approved dispute settlement bodies in Europe: https://webgate.ec.europa.eu/odr
If this mediation procedure fails, or if the User wishes to bring the matter before a court, any dispute will be settled before the competent courts.
